At-Fault Party Information

If you’re at fault in an accident with one of our clients, you may receive a request to pay for the cost of the accident replacement vehicle and/or the cost of repairs to the damaged vehicle and any other associated costs. The not-at-fault party is entitled by law to recover losses resulting from the accident.

If you are insured, please forward the request to your insurer and provide us with your insurer’s details and claim number. Contact us immediately at (02) 8840 8765 to confirm your insurer’s name and claim number. This will ensure that all future correspondence is directed to your insurer. Provided that you have fulfilled all policy requirements and paid your excess, you should not incur any out-of-pocket expenses, as your insurance is intended to cover such costs.

If you are not insured, please contact us immediately at (02) 8840 8765 to arrange payment for the accident replacement vehicle, repair costs for the damaged vehicle, and any other associated expenses.

Process

  1. We request that you complete our claim form with as much detail as possible.
  2. If the at-fault party is insured, we will seek admission of liability.
  3. Once liability is confirmed, we will advise you and you can then prepare the quotation of the vehicle should you wish to proceed. We will assist in organising an assessment by an independent assessor.
  4. When repairs are completed, please forward a copy of the final repair invoice to our office. If there has been a replacement vehicle provided, a copy of the rental agreement and invoice be provided to us.
  5. Once the repair and/or hire car invoice has been received, we will send a letter of demand for payment to the at-fault party or their insurer. Prompt Associates will manage all settlement funds and handle disbursement thereafter.

Updates

Our commitment is to maintain clear and transparent communication with all stakeholders throughout the recovery process. We will ensure you are fully informed of all progress and developments concerning the at-fault parties, their insurers, and any other involved entities. We will also inform you of any offers received, along with the insurer’s assessment reports.

Settlements

We are committed to securing a favourable settlement for repair and/or hire expenses. Should we face challenges in reaching an amicable resolution, Prompt Associates will take necessary legal steps to recover the funds.
